I believe they are the same character. Why else would they look basically the same, sound the same (at least in English) and act as tutorial/supportive characters? They also both stated to have formerly worked for Caesar: in XXL1 he outright states Caesar fired him, in XXL2 he says some confusing phrase about treachery which had "reason of treason is Caesar", so it's possible the same thing happened in that timeline. Their designs also trace back to Vitriolix in the comic Asterix the Legionary: he can be seen working for Caesar, acting similar to XXL1 spy, and his outfit looks basically the same as XXL1 spy's, except he's got a helmet.
I view XXL2 not as an actual sequel to XXL1, but rather a different timeline, which continues in OG. IDK how else to explain that Sam and Asterix meet for the first time twice.
Different timelines could also probably explain why in XXL1 Asterix and Obelix never say a word to the spy, while in XXL2 they exchange many dialogues.
according to the german wikipedia page about the asterix XXL series, the spy in XXL could as well be the spy Vitriolix from Asterix the Legionary (comic)

in German at least, I think they kept all voice actors. I'm always impressed how much better these same voice actors performed in XXL2 after the mess that XXL1 was. Only decent German voice actor in XXL1 was the spy
I heard the english voice acting of XXL1 was meh and too british
